The fight over the O'Toole building continues; Harlem gets a pretty pair of rentals.

The controversy over the O'Toole building in the West Village continues to make news. The handful of civic and historic preservation organizations who want to protect the mid-century landmarked building and St. Vincent's Hospital have been at odds over the building's fate for some time. The hospital obtained rights to demolish the building through a hardship clause authorized by the city through the claim that the hospital's ability to function as such would be significantly limited if the building were to remain in its current form.

In the latest chapter, six leading preservation organizations have filed a brief as amici curiae with the New York Supreme Court challenging the hardship ruling. The organizations' filing is based on their claim that the test for hardship was much more lenient in the case of St. Vincent's than under most circumstances, which could set a worrisome precedent for non-profit owners of landmarks to circumvent the historic preservation requirements of the Landmarks Law.
