Benjamin Shaoul was granted the right to build two extra floors at 636 East Sixth Street in exchange for providing 25 medical offices on the first and garden levels.
The Department of Buildings, however, discovered that instead of creating the medical offices, Shaoul had created 22 rental apartments to bring the building's total to 58. On the building's certificate of occupancy, Mr. Shaoul had listed 36 apartments and medical offices on the first floor and garden level.
An August 27, 2010 article by Sarah Ryley at therealdeal.com noted that "there are 58 apartments llisted on the call box."
The article noted that City Council member Rosie Mendez said that Shaoul "has overbuilt several buildings in my district all using similar tactices," adding that "this developmr repeatedly and brazenly converts community space to residential and commercial use in an effort to exceed the allowable zoning....It's a tried and true scam," she said.
The building has attractive balconies but is not convenient to subways.
