The ambitious redevelopment of NYCHA's Fulton and Elliott-Chelsea Houses in West Chelsea is set to move forward. As a partnership between NYCHA, Related Companies, and Essence Development seeks to demolish the existing public housing campuses and replace them with new mixed-income buildings, lawyers representing senior citizens who refused to move ahead of a planned demolition asserted that the plan violated a state law that said the campus must always be controlled by NYCHA. However, a state appeals court panel found that the tenants' required relocation did not qualify as irreparable harm, and that the project could proceed.
As per the terms of the city's PACT program, where NYCHA partners with private developers to rehabilitate public housing, the tenants retain their right to return after relocating to other buildings in the complex. NYCHA is required to replace each unit "one-for-one," and all tenants' rights and rents will be preserved.
